Terms of Service

1. Who these Terms cover

These Terms govern your access to and use of Pose AI, including the iOS app, website, API, account features, on-device pose and face analysis, camera guidance, photo capture, and paid subscription features. Pose AI is operated by Pedro Martins.

By creating an account, signing in, purchasing a subscription, or using Pose AI, you agree to these Terms and our Privacy Policy. Our Data Privacy overview provides a shorter explanation of how camera and account data are handled. If you do not agree, do not use the service.

2. Eligibility

You may use Pose AI only if you can legally agree to these Terms where you live. If local law requires permission from a parent or legal guardian, you may use the service only with that permission and supervision.

Do not create an account for another person, photograph a child or dependent, or process another person’s image unless you have the legal authority and permission required to do so.

3. Accounts and sign-in

You may sign in with email and password or a supported provider such as Apple or Google. You are responsible for providing accurate information, protecting your device and credentials, and all activity under your account.

You must not impersonate another person, create accounts for abuse, interfere with authentication, bypass device or session security, or attempt to access another user’s account.

4. What the service does

Pose AI provides pose cards, transparent camera guides, live framing and pose feedback, optional appearance and face-shape readings, timers, automatic capture, and camera controls. The current app analyzes live camera frames on your iPhone and can save photos to your Apple Photos library when you grant permission.

Features, pose catalog content, device compatibility, and subscription entitlements may change as the service develops.

5. Camera images, photos, and your content

You keep ownership of photos taken with Pose AI. The current app does not upload live camera frames, captured photos, or face-scan images to our servers. Captured photos are saved to your Apple Photos library only when you authorize add-only access, and a recent-capture thumbnail may remain locally in the app.

You are responsible for the images you create and share. Do not photograph or share another person without permission, violate privacy or publicity rights, create illegal or abusive material, or use the service in a way that puts anyone at risk.

If you intentionally send content to support, you grant us the limited permission needed to receive, review, secure, and respond to that request. We do not claim ownership of that content.

6. Guidance and accuracy

Pose scores, face readings, appearance categories, lighting feedback, framing suggestions, and automatic capture decisions are generated from probabilistic on-device analysis. They may be incomplete, subjective, delayed, or wrong and can vary with lighting, camera position, clothing, occlusion, and device hardware.

Pose AI is a creative photography tool, not a medical device, accessibility aid, identity system, safety system, or provider of professional photography, health, beauty, or legal advice. You are responsible for deciding whether and how to use its guidance.

7. Subscriptions, billing, cancellation, and refunds

Paid features are sold as auto-renewing subscriptions through Apple’s App Store and supported by RevenueCat for entitlement management. Prices, trial availability, renewal periods, taxes, and billing terms are shown before purchase in Apple’s purchase sheet.

Subscriptions renew automatically unless you cancel through your Apple ID or App Store subscription settings before the renewal date. Uninstalling the app, stopping use, signing out, or deleting yourPose AI account does not cancel App Store billing.

Refund requests must be submitted to Apple and are decided under Apple’s rules. Except where law requires otherwise, we do not issue separate refunds for unused time, non-use, accidental renewals, dissatisfaction, or failure to cancel before renewal.

8. Acceptable use

• Do not reverse engineer, scrape, overload, attack, tamper with, or disrupt the app, API, website, or providers.
• Do not bypass rate limits, subscriptions, authentication, purchase checks, or security controls.
• Do not use the service to violate law, intellectual-property rights, privacy, publicity rights, or another person’s safety.
• Do not automate account creation, resell access, extract the pose catalog, or use service content to build a competing product or dataset.
• Do not use the service for identification, surveillance, discrimination, emergencies, diagnosis, or another high-risk or regulated purpose.

9. Account deletion

You can delete your account in the app. The current deletion process revokes sign-in access, deletes linked login accounts and active sessions, and replaces identifying profile fields in our primary account record with anonymous values.

Deletion does not remove photos from Apple Photos, clear every local app preference or thumbnail, cancel an Apple subscription, or automatically erase purchase and customer records held by Apple or RevenueCat. Expired verification, security, backup, and legal records may remain for a limited period as described in the Privacy Policy.

10. Third-party services

Apple, Google, RevenueCat, Cloudflare, Gravatar, hosting providers, and other services involved in operating Pose AI have their own terms and policies. We are not responsible for third-party services, outages, content, account decisions, or billing decisions.

11. Service changes and termination

We may add, change, limit, suspend, or discontinue features at any time, including pose content, on-device models, account methods, device support, and subscription entitlements. We do not promise uninterrupted, secure, or error-free availability.

We may suspend or terminate access when an account violates these Terms, creates security or legal risk, abuses the service, or harms users, providers, or our operations.

12. Intellectual property

Pose AI, its software, website, branding, pose catalog, cards, guide artwork, designs, scoring methods, and service content are owned by Pedro Martins or licensors and are protected by intellectual-property laws. These Terms grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the service as intended.

13. Disclaimers and limitation of liability

The service is provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and photographic or personal outcomes.

To the maximum extent allowed by law, we are not liable for indirect, incidental, special, consequential, punitive, lost-profit, data-loss, image-loss, reputation, privacy, injury, or subscription-billing damages. Our total liability for a claim is limited to the amount you paid forPose AI during the three months before the event giving rise to the claim, or USD $50 if you paid nothing.

These limitations do not exclude rights or liability that cannot legally be excluded under the consumer laws that apply to you.

14. Apple-specific terms

Apple is not a party to these Terms and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, under App Store rules.

Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. Your use of the app must also comply with App Store rules and the Apple Media Services Terms and Conditions.

15. Changes and contact

We may update these Terms by posting a new version and changing the “Last updated” date. If a change is material, we will provide reasonable notice in the app, by email, or on the website when practical.
